A private sale puts more of the purchase process in the buyer’s hands. The seller does not have a dealership finance desk, and the legal protections differ.

Finance can still form part of a private purchase. The preparation needs to start before you promise the seller a payment date.

Check the vehicle, the seller, and the finance path before you agree to buy.

Understand the private-sale difference

New Zealand Consumer Protection guidance explains that private buyers have fewer legal protections than dealer buyers. A private seller does not have the same Consumer Guarantees Act duties as a motor vehicle dealer.

This makes the vehicle checks and written record important. It also means finance planning is only one part of the purchase.

Check the vehicle before you commit

For a private car purchase, prepare these checks:

  • view and test-drive the vehicle
  • arrange a professional pre-purchase inspection
  • record the registration, VIN, odometer, WoF, and licence details
  • keep a copy of the advertisement and the seller’s statements
  • use the PPSR TXTB4UBUY service to check for money owing
  • check whether the vehicle is listed as stolen

A valid WoF does not describe the full mechanical condition. An independent inspection gives you different information.

Prepare the finance enquiry

The lender or adviser can need details about the borrower, seller, and asset. Prepare:

  • the agreed or expected purchase price
  • your deposit
  • the amount that you want to finance
  • the seller’s name and contact details
  • the listing and vehicle details
  • proof of identity, income, and address
  • information about existing debts when requested

Put the sale terms in writing

Consumer Protection recommends keeping a written record of a private sale. The record can include the buyer, seller, vehicle, price, payment method, condition, and delivery details.

  1. Set the price range and guide repayment.
  2. Inspect the vehicle and seller information.

  5. Complete the written sale and ownership records.
